These general conditions of sale (CGV) are binding on the one hand by the company Argan Palace with capital of 700,000 DHS whose head office is located at Bloc 13 N 30 IHCHACH, 80000 - Agadir - Morocco registered in the Agadir trade and companies register under number 2180 , which operates a massage and wellness Center called Argan Palace and secondly, by any individual or legal entity wishing to purchase services (access to the Massage and Wellness Centre, facial or body treatments and any other services offered by Argan Palace) or products either via the https://www.arganpalace.com/ website, by telephone or at the Argan Palace reception desk. Any purchase implies unreserved acceptance and prior knowledge of the general conditions of sale.
The purpose of these general conditions of sale is to determine the conditions, terms and conditions of reservation, execution and cancellation of the massage and well-being center, care and massage services offered by Argan Palace, sale of products and aim to define the contractual relationships between Argan Palace and its clients (hereinafter the “Client”). Unless specifically provided, these General Terms and Conditions apply, without restriction or reservation, to all sales made remotely or at the reception of the Massage and Wellness Center by Argan Palace. The Client acknowledges that Argan Palace provided him with the necessary advice, before any reservation, and that he was able to know the content of the services offered by the Massage and Wellness Center.
The Customer acknowledges that by reserving one of the services of the Massage and Well-being Center, he has previously read these General Terms and Conditions and accepted them, without any reservation. The Client is informed that Argan Palace may be required to change the terms of these General Terms and Conditions. In this case, the applicable General Terms and Conditions will be those in force at the time of the order and/or reservation by the Customer. Acceptance of these General Terms and Conditions also implies acceptance of the internal regulations of the Massage and Wellness Center.
Access to the Massage and Wellness Center services is open, subject to availability, to Argan Palace Customers under the conditions specified when booking their treatments under the pricing conditions specified on the website https://www.arganpalace.com/.
Access to the Massage and Wellness Center, unless previously agreed, is reserved for people over 6 years of age with the agreement of their legal representative, declaring themselves to be in full legal capacity. The Customer undertakes to respect the rules of hygiene, decorum, safety, and use of equipment. In the event of violation of these rules and the internal regulations of the Massage and Wellness Center, Argan Palace reserves the right to suspend its services and immediately prohibit access to its Massage and Wellness Center. The conditions of access to the Massage and Wellness Center may change due to possible access restriction rules that may be put in place by government and administrative authorities.
The buyer who wishes to book a wellness service must either go through the website https://www.arganpalace.com/, or book by telephone, or go to the reception of the Massage and Wellness Center . In accordance with article L. 111-1 of the Consumer Code, the website www.arganpalace.com and the brochures available at the reception of the Massage and Wellness Center include the essential characteristics of massages and/or treatments and/or gift vouchers available for the Customer, who can read them before purchasing and discuss them by telephone or at the reception of the Massage and Wellness Center with our advisors.
To validate your order, that is to say the purchase of a wellness service and/or access to the Massage and Wellness Center and/or a product to be collected at the Massage and Wellness Center, the client must:
Only perfect payment will result in validation of the order, the customer will then receive at their email address a validation of their order on which the chosen service will appear. In the event that the Client had not reserved, when ordering, a date and time to carry out their treatment, it will be up to them to contact the Massage and Wellness Center, either by telephone or by email, or directly at the treatment reception.
The Customer can also order by telephone. Their contact details will be requested and an address (hotel and room number) may also be requested to validate their reservation (date and time of the services ordered).
The Customer can also order and reserve at the reception of the Massage and Wellness Center. Prior payment for services may be requested.
Whatever the terms of the order, its confirmation entails acceptance of these conditions of sale, acknowledgment of having perfect knowledge of them and the waiver of taking advantage of one's own conditions of purchase or other conditions.
All the data provided and the recorded confirmation will constitute proof of the transaction. The confirmation will constitute signature and acceptance of the operations carried out.
Subject to the terms of withdrawal and cancellation described in these General Terms and Conditions, any order and/or purchase made from Argan Palace, including gift vouchers, is firm and final. The purchase of massage and wellness center access, treatments or gift vouchers cannot be modified or refunded. Unused services do not give rise to a reduction, deduction or reimbursement. The maximum period of validity of the treatment ordered but not reserved or the gift voucher is 1 year from the date of purchase. Exceeding the validity date of the treatment or gift voucher will result in its lapse, the purchase price will remain acquired by Argan Palace.
Any appointment for a treatment and/or massage, once fixed, cannot be canceled. It can nevertheless be postponed once at the customer's request, subject to a notice period of at least 48 hours before the appointment. Otherwise, the service or gift voucher will be considered used. Argan Palace also benefits from the right to move an appointment, the new time slot having to be accepted by the Client.
The shuttle service is offered for free to all treatments reservations over 250 DHS to customers staying in hotels or residences located in the center of Agadir, although travel costs may apply if the journey exceeds 5 kilometers.
It is advisable to arrive 10 minutes before the time set for the service booked if the customer is coming by his or her own means to ensure that the treatment runs smoothly.
Customers are asked to remove their jewelry before coming to the massage and wellness center. The establishment cannot be held responsible for forgotten or stolen items. Lockers are available for customers' personal belongings. The bathrobes, towels and slippers required for the treatment are provided by the Massage and Wellness Center and handed over to the customer upon arrival at the Massage and Wellness Center. Bathing suits are provided for women and shorts for men. The actual duration of treatments includes preparation time. The accessories used by our beauticians have been disinfected beforehand. Linen is changed after each treatment.
Our cosmetic products visible on www.arganpalace.com are only offered for sale at the reception of the Massage and Well-being Center and cannot be ordered online or by telephone. No deliveries will be made. The products are offered for sale while stocks last. If the visible product is not available at the time of the Customer's visit, he may request to be informed of its availability by e-mail, indicating his e-mail address. On the website https://www.arganpalace.com/, the photographs, graphics and technical sheets are mostly taken from documentation developed by us or by image banks, reproduced under their control and with their agreement. The photographs are presented for illustrative purposes, so no complaints can be made in this respect. In the online sales process, Argan Palace is only bound by an obligation of means; it cannot be held liable for damage resulting from the use of the Internet network such as loss of data, intrusion, viruses, interruption of service, or other involuntary problems.
The prices indicated for the services and products are mentioned in Moroccan dirham all taxes included (TTC) including VAT at the rate applicable on the day of the order. Any change in the rate may be reflected in the price of the products or services on the day the service is provided by Argan Palace. Argan Palace reserves the right to change the prices of its products and services at any time. However, except in the event of an increase in the VAT rate, the price displayed on the website or in the premises of the Massage and Wellness Center on the day of the order will be the only one applicable to the Customer.
All our products benefit from guarantees under the conditions provided for by Moroccan law. The Customer has a period of two years from delivery of the goods to act as a legal guarantee of conformity. In accordance with the legal provisions in force, and in the event of a distance sale (order on the website www.arganpalace.com or by telephone), the customer is informed that he benefits for this purpose from a period of fourteen clear days running from the date of purchase of a gift voucher and/or a treatment and/or a massage and/or a service at the Massage and Wellness Center be to exercise your right of withdrawal from Argan Palace, without having to provide reasons or pay a penalty.

The treatment and massage services offered by Argan Palace constitute well-being treatments, aesthetic or not. These are relaxing services that exclude any therapeutic character or virtue. Unless otherwise specified, treatment services, massages and massages are not provided by a doctor or physiotherapist. In the event of pregnancy, a particular allergy or more generally a medical contraindication, it is recommended to obtain prior advice from a doctor and the client undertakes to notify Argan Palace.

Any dispute resulting from the execution and/or interpretation of this contract will be brought before the Agadir commercial court.
